1. Acceptance of Quote
Acceptance of this quotation by any means constitutes acceptance of the scope of work, pricing and terms and conditions contained in this quotation.
2. Scope of Work
The quoted price covers only the work and materials specifically described in this quotation. Any work, materials or services not expressly included are additional and will be charged separately.
3. Variations and Additional Work
Any changes to the agreed scope of work, additional work requested by the customer, or additional work reasonably required due to unforeseen circumstances will be treated as a variation. Variations may be charged at the applicable hourly rate plus materials, subcontractor costs and other associated costs. Where practicable, the customer will be advised of the expected additional cost before the work proceeds.
4. Materials and Subcontractors
Materials, equipment, delivery charges, disposal costs and subcontractor charges will be charged as specified in the quotation. Where the exact cost cannot reasonably be determined at the time of quoting, the actual cost may be charged.
5. Payment Terms
Unless otherwise stated on the quotation, invoices are due for payment within 7 days of the invoice date. Payment is to be made by bank transfer to the account listed on the invoice.
6. Late Payment
Amounts remaining unpaid after the due date may incur interest at 10% per month (120% per annum), calculated on the outstanding balance from the due date until payment is received in full. Interest will be calculated on a daily basis where applicable.
8. Ownership of Unpaid Materials
Ownership of materials supplied by the contractor remains with the contractor until payment for those materials has been received in full.
9. Access and Site Conditions
The customer is responsible for providing reasonable and safe access to the work site and for notifying the contractor of any known hazards, restrictions, underground services or other conditions that may affect the work.
10. Delays
The contractor will not be responsible for delays caused by circumstances beyond the contractor’s reasonable control, including weather, material shortages, supplier delays, unforeseen site conditions, illness, availability of subcontractors, or delays caused by other trades or the customer.
11. Customer-Supplied Materials
Where the customer supplies materials, the contractor is not responsible for defects, shortages, incorrect quantities, incompatibility or other problems arising from those materials. Additional labour or costs resulting from customer-supplied materials may be charged.
12. Existing Structures and Work
Where work is carried out on or connected to existing structures, the quotation is based on conditions reasonably visible or known at the time of quoting. Defects, deterioration, non-compliant construction or concealed conditions discovered during the work may require additional work and may result in additional charges.
13. Quote Validity
Unless otherwise stated, this quotation is valid for 30 days. The quoted prices are subject to change after this period.
14. Cancellation
If the customer cancels or postpones the work after acceptance of the quotation, the customer may be responsible for costs already incurred, materials ordered, subcontractor commitments and reasonable cancellation or administration costs.
15. GST
All prices are exclusive of GST, as stated in the quotation.
16. Workmanship
The contractor will carry out the agreed work with reasonable care and skill and in accordance with applicable requirements. Any concerns regarding workmanship should be notified to the contractor as soon as reasonably practicable so that they can be investigated and, where appropriate, remedied.
17. Customer Responsibilities
The customer is responsible for providing accurate information relevant to the work, obtaining any approvals or permissions that are specifically the customer’s responsibility, and ensuring that the contractor has reasonable access to the site for the duration of the work.
18. Disputes
If a dispute arises, both parties agree to first attempt to resolve the matter directly and in good faith. Nothing in these terms limits any rights or remedies available to either party under New Zealand law.
19. Statutory Rights
Nothing in these terms is intended to exclude, restrict or limit any rights or obligations that cannot legally be excluded, restricted or limited under New Zealand law.
20. Acceptance
By accepting this quotation or instructing the contractor to commence work, the customer confirms that they have read and accepted the quotation, scope of work, pricing and these terms and conditions.
